How long service leave works in New South Wales
Long service leave in New South Wales is set by the Long Service Leave Act 1955 (NSW), not the national Fair Work Act, so the rules differ from other states. This is how the calculator works it out:
- Count continuous service with the one employer (or a related business). Paid leave counts. Unpaid parental leave does not count as service but does not break continuity.
- Accrue at 0.8667 weeks a year: 2 months (8.67 weeks) after 10 years, then 1 month (4.33 weeks) for each further 5 years.
- Subtract leave already taken or paid out.
- Check the stage. Leave can be taken once 10 years are reached. If employment ends after 5 years, a pro-rata payment can apply on the grounds the Act lists: after 5 years but before 10, only if employment is terminated by the employer for any reason other than serious and wilful misconduct, by the worker on account of illness, incapacity or domestic or other pressing necessity, or by death (lsl act 1955 s 4(2)(a)(iii)). from 10 years, payable on termination for any reason.

What happens to long service leave if I leave my job in New South Wales?
Nothing is payable before 5 years of continuous service.
